Terms of Service

1. Acceptance of Terms

By requesting or receiving our Services (“Services”), you (“Client”) agree to these Terms, our Privacy Policy, and Cookie Policy.


2. Offer, Acceptance & Consideration

The written Quote is our offer. Contract is binding when you accept via signature, deposit, or clicking “Accept,” which reflects mutual consideration (services for payment).


3. Capacity & Legality

You confirm you are at least 18 years old, legally competent, and the Services are lawful.


4. Scope of Services

Services include preparation, painting, cleanup, and minor repairs as specified in the Quote. Any additional items require a signed Change Order.


4A. Color, Paint & Materials

Owner‑Supplied Materials: Client assumes all responsibility for paint/materials provided. Contractor is not liable for associated issues.Sample Approval Required: A test patch or sample is required; full work proceeds only after the Client provides written approval. Acknowledgment of Variation: Slight shade or sheen variation is normal and acceptable unless it's a gross mismatch. Documentation: Contractor will keep a dated photo and written sign-off as record.


5. Project Timeline

Work begins and ends on agreed dates. Contractor isn’t responsible for delays due to weather, site conditions, or Client-caused issues. Rescheduling may incur fees.


6. Client Responsibilities

Provide site access and utilities.Remove personal items.Site safety: Children must remain off-site; pets must be contained during work.


7. Pricing & Payment

Deposit due at acceptance.Balance due at start or completion.Late payments accrue up to 18% APR or max legal rate.


8. Changes & Additional Work

All scope changes require written Change Orders and additional payment.


9. Licensing & Permits

Florida does not require a specific painting license. We maintain local business registrations. Client is responsible for obtaining required permits or approvals (e.g., HOA, local permits).


10. Financing (If Applicable)

Financing Addendum will be provided if extended payment is selected, disclosing total financed, APR, schedule, late/prepayment terms—compliant with Florida’s Consumer Finance Act and TILA.


11. Cancellation by Client & Cancellation Fees

Cancellation After Paint/Prep Start: Must be in writing.Fees: Includes non-recoverable costs plus 20% cancellation fee of Quote.Fee Reduction: Deposit and fees reduced if the slot is reassigned.Termination for Cause: Contractor may terminate for unsafe conditions or Client breaches.Contractor Cancellation: Full refund or reschedule offered with no penalty.


12. Independent Contractor

Contractor is an independent contractor, not an employee or agent.


13. Warranties & Disclaimer

Workmanship warranted to industry-standard.Not liable for misuse, wear, or external conditions.All other warranties are disclaimed.


14. Limitation of Liability

Liability capped at the greater of (A) payments in prior 12 months or (B) $5,000. No liability for indirect, incidental, or consequential damages.


15. Termination

Either party can terminate for material breach if uncured within 14 days of written notice. Non-refundable completed work.


16. Indemnity

Client indemnifies Contractor for claims caused by Client negligence, site conditions, or breaches.


17. Force Majeure

Contractor is not liable for delays due to uncontrollable events (e.g., storms, strikes, pandemics).


18. Dispute Resolution & Governing Law

Florida law governs. a. Mediation first: Before any formal legal action, parties agree to attempt best-faith mediation

within 30 days, hiring a neutral mediator.


b. Arbitration next: If mediation fails to resolve the matter within 60 days, the dispute will be submitted to binding arbitration

under the rules of the American Arbitration Association, conducted in Palm Beach County, Florida. The arbitrator’s decision will be final and enforceable,

with each party bearing their own costs.

19. Intellectual Property

Contractor retains all IP rights in designs, photos, or content unless transferred in writing.


20. Website Use

Use of the Contractor’s website is subject to these Terms as well as Privacy and Cookie Policies.


21. Entire Agreement & Modifications

This document combined with Quote, Privacy, and Cookie Policies represents the entire agreement. Changes must be written and signed.


22. Effective Date & Authorization

Acceptance via signature, payment, or click affirms you have read, understood, and agree to be bound as of the acceptance date.
